Conference on Conflict of Laws in International Arbitration

In the context of international arbitration, conflict of laws is a neglected area of study.

Though a limited number of questions – such as the law governing the arbitration agreement – has received outsized public attention, the broader array of conflicts issues encountered by arbitrators every day is less well-studied. Consequently, arbitrators face an uphill battle determining the law governing privilege, ethical duties, or insolvency-related actions, for which institutional rules and the lex arbitri frequently provide only barebones guidance.

The conference, organized by Professor Matthias Lehmann of the Department for Comparative, Uniform and Private International Law of the University of Vienna, will aim to address this gap. It complements the work of the ILA Committee on Conflict of Laws Issues in International Arbitration, which was constituted in December 2024.
